Terms and Conditions for Time to Sing App

1. General Information

These Terms and Conditions ("Terms") govern your access to and use of the Time to Sing mobile application ("App"), including any content, functionality, and services offered through the App. The App is owned and operated by Kirill Zolygin und Karine Kardasheva GbR ("we," "us," or "our"), with its principal place of business at Blissestraße 68, 10713 Berlin, Germany.

By downloading, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the App.

2. App Description and Services

Time to Sing is an application that offers singing exercises and vocal warm-ups for different voice types, experience levels, and styles including classical, pop, and musical theater. The App operates on a freemium model, allowing users to access selected exercises for free with the option to start a trial or purchase premium access.

The App may include onboarding, favorites, playlists, practice progress tracking, reminders, push notifications, account management, support and feedback tools, and other features designed to help users build a regular vocal practice. We may change, add, remove, or limit features and content from time to time.

3. User Accounts

Registration Requirements

To use certain features of the App, you must register for an account. When you register, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Age and Eligibility

The App is not intended for children under 16 years of age. By creating an account or using the App, you confirm that you are at least 16 years old or that you use the App with the consent and supervision of a parent or legal guardian where required by applicable law.

User Content

You may have the option to upload a profile picture. You retain all rights to any content you submit, post, or display on or through the App.

Account Deletion

You may request deletion of your account through the App or through the account deletion instructions provided on our website. Deleting your account removes or anonymizes account-related data from our active systems, subject to technical processing time, backups, legal obligations, fraud prevention, tax, accounting, and legitimate business record requirements.

4. Payment Terms

Subscription and Purchases

The App offers free access to certain exercises, with the option to start a free trial, subscribe, or purchase premium access where available. Premium access may unlock additional exercises, playlists, guided practice content, or other paid features shown in the App.

Pricing and Billing

All prices, trial periods, renewal periods, and included features are displayed in the App before purchase and may vary by country, platform, currency, promotions, taxes, or app store rules. By completing a purchase, you agree to pay the specified amount through the applicable app store account.

Trials, Renewal, and Cancellation

If you start a free trial or subscription, it may automatically renew unless you cancel before the end of the trial or then-current subscription period. You can manage or cancel subscriptions through your Apple App Store or Google Play account settings. Uninstalling the App does not automatically cancel a subscription.

Refunds

Refunds, cancellations, billing disputes, and payment methods are governed by the terms and policies of the applicable app store, including Apple App Store or Google Play. We do not process app store refunds directly.

5. Data, Privacy, and Communications

Privacy Policy

Our collection and use of personal data is described in our Privacy Policy. By using the App, you acknowledge that we process account, device, subscription, usage, practice, onboarding, paywall, notification, and support-related data as described there.

Third-Party Services

The App relies on third-party services for functions such as authentication, database hosting, storage, push notifications, subscription management, payments, app distribution, and diagnostics. These services may include Supabase, RevenueCat, Apple, Google, Expo, and other infrastructure providers used to operate the App.

Push Notifications and Reminders

If you enable notifications, we may send practice reminders, trial reminders, account-related messages, updates, and re-engagement messages. You can disable push notifications in the App settings or your device settings. Delivery of notifications is not guaranteed and may depend on your device, operating system, network, app version, and notification permissions.

6. Intellectual Property Rights

Our Rights

The App and its entire contents, functions, and functionalities (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Kirill Zolygin und Karine Kardasheva GbR and are protected by German and international copyright, trademark, and other intellectual property laws.

Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

Restrictions

You may not:

• Modify, copy, or create derivative works based on the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or other proprietary notices
• Transfer, sell, rent, or lease the App to any third party

7. User Conduct

You agree not to use the App:

• In any way that violates applicable laws or regulations
• To impersonate or attempt to impersonate us or any other person or entity
• To engage in any conduct that restricts or inhibits anyone's use of the App
• To attempt to gain unauthorized access to the App or related systems

8. Disclaimers and Limitations of Liability

Disclaimer of Training Results

TIME TO SING APP AND KIRILL ZOLYGIN UND KARINE KARDASHEVA GBR DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE SINGING EXERCISES PROVIDED IN THE APP. RESULTS MAY VARY DEPENDING ON INDIVIDUAL VOCAL ABILITIES, CONSISTENT PRACTICE, PROPER TECHNIQUE IMPLEMENTATION, AND OTHER FACTORS BEYOND OUR CONTROL. THE EXERCISES ARE PROVIDED 'AS IS' WITHOUT ANY WARRANTY OF IMPROVEMENT OR ACHIEVEMENT OF SPECIFIC VOCAL GOALS.

Implementation Disclaimer

USERS ACKNOWLEDGE THAT IMPROPER IMPLEMENTATION OF SINGING TECHNIQUES AND EXERCISES MAY RESULT IN VOCAL STRAIN OR OTHER UNDESIRED OUTCOMES. USERS ARE SOLELY RESPONSIBLE FOR HOW THEY IMPLEMENT THE INFORMATION AND EXERCISES PROVIDED IN THE APP. KIRILL ZOLYGIN UND KARINE KARDASHEVA GBR SHALL NOT BE LIABLE FOR ANY INJURY, DISCOMFORT, OR DAMAGE RESULTING FROM INCORRECT OR INAPPROPRIATE USE OF THE APP'S CONTENT.

No Professional Advice Disclaimer

THE CONTENT PROVIDED IN TIME TO SING APP IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL VOCAL COACHING OR MEDICAL ADVICE. USERS WITH EXISTING VOCAL HEALTH ISSUES SHOULD CONSULT WITH A QUALIFIED VOCAL COACH, SPEECH THERAPIST, OR MEDICAL PROFESSIONAL BEFORE USING THE APP. USERS ASSUME ALL RISK WHEN IMPLEMENTING THE TECHNIQUES AND EXERCISES PROVIDED.

Vocal Health and Safe Use

You should stop using an exercise if you experience pain, unusual discomfort, dizziness, hoarseness, or vocal strain, and seek professional advice where appropriate. The App cannot assess your individual vocal condition, technique, health status, environment, or suitability for a specific exercise.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KIRILL ZOLYGIN UND KARINE KARDASHEVA GBR, ITS PARTNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER IMMATERIAL LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.

9. Changes to Terms

We may revise these Terms from time to time by updating this page and the "Last updated" date. If changes are material, we may provide additional notice in the App or by other reasonable means. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
